Lucubrare was created to help people enjoy their own videos and images as beautiful live wallpapers while respecting their privacy and ownership. These Terms of Use explain the rules that apply when you download, purchase, subscribe to, access, or use Lucubrare and are intended to be clear, fair, and easy to understand.

Your media remains yours

You retain ownership of the videos, images, and other media you import into Lucubrare. You are responsible for having the right to use that content.

Subscriptions are managed by Apple

Purchases, renewals, cancellations, subscription eligibility, and refunds are processed through Apple and your App Store account.

Lucubrare is local-first

Imported wallpaper media is processed and displayed locally on your Mac. Lucubrare does not require you to create a Lucubrare account.

1. Agreement to These Terms

These Terms of Use constitute an agreement between you and the provider of Lucubrare regarding your use of the Lucubrare application for macOS, its official wallpaper library, related support resources, and associated Lucubrare webpages.

By downloading, installing, purchasing, subscribing to, accessing, or using Lucubrare, you confirm that you have read, understood, and agree to these Terms of Use.

If you do not agree to these terms, do not purchase, install, access, or use Lucubrare.

If you use Lucubrare on behalf of a company, organization, or other legal entity, you represent that you are authorized to accept these terms on that entity's behalf.

2. Apple Standard End User License Agreement

Lucubrare is distributed through the Mac App Store. Unless a separate custom license agreement is expressly provided for Lucubrare through Apple, your license to use the application is also governed by Apple's Standard End User License Agreement for applications distributed through the App Store.

These Lucubrare Terms of Use supplement Apple's applicable license terms. If these terms conflict with mandatory Apple App Store terms, Apple's applicable terms will control to the extent of that conflict.

3. Eligibility

You may use Lucubrare only if you are legally capable of entering into a binding agreement under the laws that apply to you.

If you are not old enough to enter into a binding agreement in your country or region, you may use Lucubrare only with the permission and supervision of a parent or legal guardian.

You are responsible for complying with any age, account, payment, or family-sharing requirements imposed by Apple.

4. License to Use Lucubrare

Subject to these Terms of Use, Apple's applicable license terms, and any applicable subscription or purchase requirements, Lucubrare grants you a limited, personal, non-exclusive, non-transferable, and revocable license to use the application on Apple devices that you own or control, as permitted by Apple's usage rules.

Lucubrare is licensed, not sold. No ownership interest in the application, its source code, design, branding, interface, official wallpaper library, documentation, or other proprietary materials is transferred to you.

Except where applicable law expressly permits otherwise, you may not:

  • Copy, reproduce, or redistribute Lucubrare as a standalone product
  • Sell, sublicense, rent, lease, lend, or commercially transfer the application
  • Reverse engineer, decompile, disassemble, or attempt to derive the application's source code
  • Circumvent, interfere with, disable, or manipulate subscription, purchase, licensing, or access controls
  • Remove or alter copyright, trademark, attribution, or ownership notices
  • Use Lucubrare to create, distribute, conceal, or operate malicious software
  • Use Lucubrare in a manner that violates applicable law, these terms, or the rights of another person

5. Application Features

Lucubrare allows users to create and display live wallpapers using supported videos, images, and other media selected by the user. Lucubrare may also provide an official library of curated wallpaper content.

Depending on the application version and your subscription status, available features may include:

  • Importing supported videos and images
  • Creating and displaying live wallpapers
  • Generating local previews, thumbnails, or converted media
  • Assigning wallpapers to compatible connected displays
  • Managing a local wallpaper library
  • Controlling playback, volume, mute, shuffle, and display settings
  • Accessing official Lucubrare wallpaper content
  • Restoring eligible purchases and subscriptions through Apple

Features may vary based on your Mac model, macOS version, display configuration, media format, available storage, system resources, subscription status, and application version.

Lucubrare does not guarantee that every video, image, codec, resolution, frame rate, color profile, audio format, or display configuration will be supported.

6. Your Videos, Images, and Other Media

You retain ownership of the videos, images, and other media that you import into Lucubrare. Lucubrare does not claim ownership of your imported content.

You grant Lucubrare only the limited permission necessary to process, copy, convert, store, preview, organize, and display that media locally on your Mac in order to provide the features you request.

You are solely responsible for ensuring that you have all necessary ownership rights, licenses, permissions, and authorizations to use imported media through Lucubrare.

You must not use Lucubrare to import, reproduce, process, display, distribute, or otherwise use content in a manner that:

  • Infringes copyright, trademark, privacy, publicity, contractual, or other rights
  • Violates the license terms or terms of service governing the content
  • Violates applicable law or a valid court or governmental order
  • Contains unlawful, malicious, exploitative, or intentionally harmful material
  • Is used to harass, threaten, impersonate, exploit, or harm another person

Lucubrare is a media-display and wallpaper-management application. It does not grant you rights to content owned or controlled by third parties.

You are responsible for maintaining backups of important original media. Lucubrare should not be treated as the sole archival storage location for irreplaceable videos or images.

7. Official Lucubrare Content

Lucubrare may include or provide access to videos, images, thumbnails, artwork, metadata, names, descriptions, and other materials supplied as part of the official Lucubrare wallpaper library.

Official Lucubrare content is owned by Lucubrare, licensed to Lucubrare, or otherwise used with authorization. It is provided to you under a limited license for personal use within Lucubrare.

Unless Lucubrare expressly authorizes otherwise in writing, you may not:

  • Sell or sublicense official Lucubrare content
  • Redistribute official Lucubrare content as standalone media files
  • Upload official Lucubrare content to stock-media libraries, wallpaper marketplaces, or competing applications
  • Claim ownership or authorship of official Lucubrare content
  • Remove embedded attribution, ownership notices, metadata, or technical protections
  • Use official Lucubrare content to create a competing commercial wallpaper library

Access to individual official wallpapers may change over time. Lucubrare may add, update, replace, correct, retire, or remove official content when reasonably necessary.

8. Purchases and Subscriptions

Lucubrare may offer paid features through auto-renewable monthly or annual subscriptions processed by Apple through the Mac App Store.

The title, duration, price, billing period, renewal terms, and any applicable introductory offer will be presented through Lucubrare and Apple's purchase interface before you confirm a purchase.

Subscription prices may vary by country or region and may include taxes or currency conversion as determined by Apple.

Payment is charged to the Apple Account associated with your App Store purchase after you confirm the transaction.

Auto-renewable subscriptions renew automatically at the end of each billing period unless you cancel the subscription through your Apple Account settings before the applicable renewal date.

Cancellation stops future automatic renewals. Unless Apple provides otherwise, cancelling a subscription does not immediately remove access. You may continue using eligible subscription features until the end of the period for which payment has already been made.

Deleting or uninstalling Lucubrare does not automatically cancel an active subscription.

Apple controls payment processing, taxes, billing, renewal, cancellation, subscription management, payment-method issues, family sharing where applicable, and the final approval or denial of refund requests.

You can manage or cancel your subscription through the subscription settings associated with your Apple Account.

9. Introductory Offers and Free Trials

Lucubrare may offer an introductory price, free trial, discounted period, or other promotional subscription offer to eligible users.

Eligibility is determined through Apple and may depend on your previous subscription activity within the applicable subscription group.

Introductory offers are available only to users whom Apple determines to be eligible. An offer shown in marketing materials does not guarantee that the offer will be available to every user, country, region, device, or Apple Account.

Unless cancelled before the introductory or free-trial period ends, the subscription will automatically renew at the standard price and billing frequency presented before purchase.

Apple may limit users to one introductory offer per subscription group. Reinstalling Lucubrare, creating a new local application library, or deleting local settings does not reset eligibility determined by Apple.

10. Restoring Purchases

Lucubrare provides a method for requesting restoration or synchronization of eligible App Store purchases and subscriptions.

Restoration requires the appropriate Apple Account and may require access to Apple services. Lucubrare cannot restore a purchase made under a different Apple Account unless Apple recognizes that account as entitled to the purchase.

Restoring purchases does not create a new subscription or charge you again. It asks Apple to verify purchases associated with the applicable account.

Temporary Apple service interruptions, account sign-out, network unavailability, billing issues, or delayed transaction updates may affect how quickly subscription status can be verified.

11. Refunds and Customer Satisfaction

Customer satisfaction is important to Lucubrare. If you experience a technical problem or believe Lucubrare is not working as described, please contact Lucubrare Support so that we can help investigate the issue.

Purchases and subscriptions made through the Mac App Store are billed and processed by Apple. Refund requests must therefore be submitted to Apple and are reviewed under Apple's applicable refund rules, payment policies, and consumer-protection requirements.

Lucubrare cannot directly issue, approve, deny, or guarantee a refund for a transaction processed by Apple.

We intend to support reasonable refund requests, including requests from monthly subscribers who are dissatisfied and annual subscribers who determine shortly after purchasing that Lucubrare is not suitable for them. However, Apple retains final authority to approve or deny App Store refund requests.

Nothing in these terms limits any mandatory refund, cancellation, or consumer rights that apply in your country or region.

12. Availability and Changes

Lucubrare may be updated from time to time to add features, improve reliability, maintain compatibility, address security concerns, comply with legal requirements, or correct defects.

We may modify, suspend, discontinue, replace, or limit part of the application or its official content when reasonably necessary.

We do not guarantee that every feature, wallpaper, media format, display configuration, or application version will remain available indefinitely.

Some changes may be required because of updates to macOS, Apple frameworks, hardware behavior, StoreKit, App Store rules, security requirements, or third-party components.

We will not intentionally remove paid access solely to avoid providing benefits that were already purchased, subject to Apple's purchase records, applicable law, technical feasibility, and these terms.

13. System Performance and Compatibility

Live video wallpaper playback may use processor, graphics, memory, battery, storage, and other system resources. Resource usage can vary significantly depending on:

  • Video resolution, codec, frame rate, duration, and bitrate
  • The number and resolution of connected displays
  • Your Mac model and hardware configuration
  • Other applications running at the same time
  • macOS power-management and display settings
  • Whether audio playback is enabled

You are responsible for choosing media and settings appropriate for your device and working environment.

Lucubrare may pause, reduce, restart, or otherwise manage wallpaper playback when necessary to respond to sleep, wake, display changes, power conditions, resource pressure, or macOS behavior.

Lucubrare does not guarantee uninterrupted playback under every hardware, power, display, or system configuration.

14. Local Storage and Backups

Lucubrare may create local copies, previews, thumbnails, converted files, configuration data, and other application-support materials necessary to manage your wallpaper library.

Imported media and generated application data may consume substantial storage space, particularly when high-resolution or long-duration videos are used.

You are responsible for:

  • Maintaining sufficient available storage
  • Keeping backups of important original files
  • Confirming that imported media was copied or preserved as expected
  • Removing wallpapers and application-support data you no longer need

Uninstalling Lucubrare may not automatically delete every locally stored application-support file or preference created by macOS or the application.

15. Acceptable Use

You agree not to misuse Lucubrare or use it in a manner that harms the application, Apple services, another person, or another person's rights.

You must not:

  • Use Lucubrare to violate copyright, privacy, publicity, contract, or other legal rights
  • Attempt to bypass subscription, purchase, licensing, sandbox, or security controls
  • Introduce malware, corrupted files, malicious code, or intentionally harmful media
  • Attempt to gain unauthorized access to Lucubrare systems, Apple services, or another person's device or data
  • Use automated means to extract, duplicate, or redistribute the official Lucubrare library
  • Misrepresent Lucubrare, impersonate Lucubrare Support, or falsely claim affiliation with Lucubrare
  • Use Lucubrare for unlawful surveillance, harassment, exploitation, threats, or abuse
  • Use Lucubrare in any manner prohibited by Apple's applicable terms or usage rules

16. Lucubrare Intellectual Property

Lucubrare, including its application code, design, interface, branding, logos, names, documentation, official wallpaper library, graphics, metadata, and associated materials, is protected by copyright, trademark, and other intellectual-property laws.

Except for the limited license expressly granted under these terms, all rights in Lucubrare and its official content are reserved.

The Lucubrare name, logo, visual identity, and related branding may not be used in a manner that suggests endorsement, sponsorship, affiliation, or authorization without prior written permission.

17. Feedback and Suggestions

You may choose to send Lucubrare feedback, ideas, feature requests, error reports, or suggestions.

By submitting feedback, you allow Lucubrare to review, use, adapt, and incorporate that feedback to improve the application without an obligation to compensate you.

This section does not transfer ownership of your imported videos, images, or other personal media.

18. Apple and Third-Party Services

Lucubrare relies on Apple services for application distribution, payment processing, subscriptions, purchase verification, refunds, and certain operating-system functionality.

Your use of the Mac App Store, Apple Account, Apple payment systems, subscription management, refund tools, macOS, and other Apple services is governed by Apple's own terms and policies.

Lucubrare may include links to third-party websites or services for support, legal information, or related resources. Lucubrare does not control and is not responsible for the availability, content, privacy, security, or practices of those third parties.

Apple is not responsible for providing Lucubrare support, except to the extent Apple expressly agrees otherwise under its own terms.

19. Privacy

Lucubrare is designed as a local-first application. Its handling of imported media, application settings, purchase information, device permissions, and other information is described in the Lucubrare Privacy Policy.

By using Lucubrare, you acknowledge that you have had an opportunity to review the Privacy Policy.

20. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Lucubrare is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory.

To the maximum extent permitted by law, Lucubrare disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, and uninterrupted availability.

Lucubrare does not warrant that:

  • The application will operate without interruption or error
  • Every media file or hardware configuration will be compatible
  • Wallpaper playback will remain uninterrupted at all times
  • Every defect will be corrected immediately
  • The application will remain compatible with every future macOS, Apple hardware, StoreKit, or App Store change
  • Local application data can never be lost, corrupted, deleted, or affected by device failure

Some countries, states, or regions do not allow certain warranty exclusions. In those locations, the exclusions above apply only to the maximum extent legally permitted.

21. Limitation of Liability

To the maximum extent permitted by applicable law, Lucubrare and its provider will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to Lucubrare.

This includes, without limitation, damages relating to:

  • Loss of profits, revenue, business, or opportunity
  • Loss, corruption, deletion, or unavailability of media or data
  • Device, display, battery, storage, or performance issues
  • Application downtime or interrupted wallpaper playback
  • Inability to access subscription features temporarily
  • Third-party services, Apple services, or external websites
  • Unauthorized or unlawful use of media imported by a user

To the maximum extent permitted by law, Lucubrare's total aggregate liability arising out of or relating to the application will not exceed the greater of:

  • The amount you paid for Lucubrare during the twelve months immediately preceding the event giving rise to the claim
  • Fifty United States dollars

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, intentional misconduct, or rights protected by mandatory consumer-protection law.

22. Responsibility for Your Use

To the extent permitted by applicable law, you are responsible for claims, damages, losses, liabilities, and expenses arising from:

  • Your unlawful or unauthorized use of Lucubrare
  • Your violation of these Terms of Use
  • Media you import, process, display, distribute, or otherwise use
  • Your infringement of another person's legal rights
  • Your intentional misuse of the application

This section does not require you to accept responsibility for conduct caused solely by Lucubrare or for liability that applicable law does not permit Lucubrare to transfer to you.

23. Suspension and Termination

Your right to use Lucubrare may end if:

  • You uninstall or stop using the application
  • Your paid subscription expires or is revoked
  • Apple refunds or reverses the applicable purchase
  • You materially violate these Terms of Use
  • Continued access would violate applicable law, Apple requirements, or another person's rights

Where reasonably possible, Lucubrare will seek to avoid unnecessary loss of access and will distinguish confirmed subscription expiration from temporary verification problems.

Termination of your license does not transfer ownership of your personal media to Lucubrare.

Sections that by their nature should continue after termination will survive, including sections concerning ownership, user responsibility, warranties, liability, dispute rules, and general legal terms.

24. Consumer Rights

You may have mandatory rights under the consumer-protection laws of your country, state, province, or region.

Nothing in these Terms of Use excludes, restricts, waives, or limits rights that cannot legally be excluded, restricted, waived, or limited.

If a provision of these terms conflicts with mandatory consumer law, that provision will apply only to the extent permitted, and your mandatory rights will remain unaffected.

25. Governing Law

These Terms of Use are governed by the laws applicable under Apple's Standard End User License Agreement and any mandatory law that applies based on your place of residence.

Nothing in this section deprives you of the protection of mandatory consumer laws or legal forums available to you under applicable law.

26. Changes to These Terms

These Terms of Use may be updated when Lucubrare's features, subscription structure, legal obligations, business practices, official content, Apple requirements, or third-party integrations change.

Any revised version will be posted on this page with a new “Last updated” date.

Material changes may also be communicated through the application, its App Store listing, release notes, or another reasonable notice method.

Changes will not retroactively reduce mandatory consumer rights or remove benefits already owed under an active paid subscription except where required by law, Apple, security needs, or technical necessity.

Your continued use of Lucubrare after updated terms become effective constitutes acceptance of the revised terms to the extent permitted by applicable law.

27. General Terms

These Terms of Use, the Lucubrare Privacy Policy, Apple's applicable terms, and any purchase information presented before checkout form the agreement governing your use of Lucubrare.

If any provision of these terms is found invalid or unenforceable, the remaining provisions will remain in effect. The invalid provision will be interpreted or modified only to the minimum extent necessary to make it enforceable where legally permitted.

Lucubrare's failure to enforce a provision does not waive the right to enforce it later.

You may not transfer your rights or obligations under these terms except as permitted by Apple or with prior written authorization. Lucubrare may transfer these terms as part of a lawful business reorganization, merger, financing, acquisition, or sale of assets, subject to applicable law.
